1. Introduction & Seller Details These Terms and Conditions apply to this website (www.marmaayurveda.org/eu) and to transactions related to our products and services. You may be bound by additional contracts related to your relationship with us or any products or services that you receive from us. In case of conflicts, the provisions of those additional contracts shall prevail.

Currently, services and products are provided by: Piotr Czopek, operating as a sole trader under the name Marma Ayurveda Piotr Czopek entered into the Central Registration and Information on Business (CEIDG) kept by the minister competent for economy in Poland.

2. Binding By registering, accessing, or otherwise using this website, booking a consultation, or purchasing from our shop, you agree to these Terms and Conditions. The use of this website implies knowledge and acceptance of these terms. These terms constitute a legally binding remote contract under the Polish Consumer Rights Act of 30 May 2014.

3. Electronic Communication You agree to electronic communications via our website or email, which satisfy any legal requirements for written communications.

4. Intellectual Property We or our licensors own all intellectual property rights on this website, including but not limited to text, blog articles, logos, and course materials, protected under Polish and EU Copyright laws.

  • 4.1 All Rights Reserved: You are not permitted to use, copy, reproduce, distribute, embed, alter, reverse engineer, monetise, sell, or commercialise resources, articles, or digital products from this website without prior written permission.

5. Newsletter You may forward our free electronic newsletters or blog posts to interested parties, provided you do not alter the content and you credit Marma Ayurveda.

6. Third-Party Property Our website may link to third-party sites (e.g., social media platforms, external articles), for which we bear no responsibility or liability.

7. Responsible Use Use the website only for lawful purposes. Activities causing damage, harassment, or interference to the site’s functionality are strictly prohibited.

8. Registration and Customer Accounts When creating a shop account, maintain the confidentiality of your passwords and information. Notify us immediately of any unauthorised account usage.

9. Refund, Return, and Complaint Policy (EU/Polish Consumer Rights) This section applies to physical and digital products purchased through the website. For cancellation policies regarding Ayurvedic consultations, Marma therapy, Kalaripayattu training, and retreats, please refer to Section 17.

  • 9.1 Statutory Right of Withdrawal (Physical Goods): Under the Polish Consumer Rights Act, consumers within the EU have a legal right to withdraw from a remote sales contract without giving any reason within 14 days of receiving the goods.
    • Notification: You must unequivocally notify us of your decision to withdraw within 14 days of the delivery date (e.g., via email). You may use a standard withdrawal form, but it is not obligatory.
    • Return Window: Once you have notified us, you have a further 14 days to return the physical items to us.
    • Condition: You are liable for any diminished value of the goods resulting from handling them other than what is necessary to establish the nature, characteristics, and functioning of the goods.
  • 9.2 Non-Returnable Items (Hygiene & Digital Exceptions): Pursuant to Article 38 of the Polish Consumer Rights Act, the right of withdrawal does not apply to:
    • Hygiene & Personal Care: Goods delivered in sealed packaging which cannot be returned for health protection or hygiene reasons if the packaging has been opened after delivery (e.g., cosmetics, massage oils, herbal supplements, copper cups, tongue scrapers, neti pots).
    • Digital Content: The supply of digital content (eBooks, digital courses) which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and their acknowledgment that they thereby lose their right of withdrawal.
    • Gift Vouchers: Gift cards and treatment vouchers.
  • 9.3 Faulty Goods and Complaints (Rękojmia / Statutory Warranty): Under Polish law (Kodeks cywilny), we are obliged to deliver goods free from physical and legal defects.
    • If a product is defective, you have the right to file a complaint (reklamacja) demanding a repair, replacement, price reduction, or, in the case of a material defect, withdrawal from the contract.
    • Please submit complaints via email to info@marmaayurveda.org, preferably with photographic evidence.
    • Response Time: We will formally respond to your complaint within 14 days of receiving it. Failure to respond within 14 days implies we have accepted your complaint as justified.
  • 9.4 The Refund Process: If your return or complaint is approved, your refund will be processed, and a credit will automatically be applied to your original method of payment without undue delay, and no later than 14 days from the day we are informed of your decision. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent them back, whichever is earliest.
    • Original Outbound Shipping: We will refund the basic delivery cost you paid to receive the item (we do not refund enhanced delivery costs chosen by you).
  • 9.5 Return Shipping: To return your product, please mail it to: Marma Ayurveda Piotr Czopek, ul. Leżakowa 9, 93-430 Łódź, Poland.
    • Customer Responsibility: Unless the item is being returned due to a recognised defect (complaint), you are responsible for paying the direct costs of returning the goods.

10. Idea Submission Do not submit intellectual property unless we have signed a prior agreement. Without such agreement, submissions become the non-exclusive, royalty-free property of Marma Ayurveda.

11. Prices and Payments All prices presented on the website are gross prices (including VAT at the applicable rate) and are expressed in PLN & EUR. Available payment methods are detailed at checkout.

12. Warranties and Liability We disclaim all warranties regarding website content availability, accuracy, and specific health outcomes. Our liability to businesses (B2B) is limited to the price paid. Consumer rights (B2C) remain unaffected by this limitation, governed by absolute provisions of law.

13. Privacy and Personal Data (GDPR/RODO) Your personal and health data are processed in accordance with Regulation (EU) 2016/679 (GDPR / RODO). Personal data provided during registration and booking must be accurate. See our Privacy Policy and Cookie Policy for full details on how we protect and process your data.

14. Legal Compliance Use of this website in violation of Polish and EU laws and regulations is prohibited.

15. Choice of Law, Jurisdiction, and ODR These Terms are governed by the laws of Poland. Disputes arising between us and a consumer may be submitted to competent common courts in Poland. However, this choice of law does not deprive an EU consumer of the protection granted by provisions that cannot be derogated from by agreement by virtue of the law of the consumer's habitual residence.

  • Out-of-Court Dispute Resolution (ODR): In accordance with EU Regulation No. 524/2013, we inform you that consumers have the right to resolve disputes out of court via the European ODR platform, available at: http://ec.europa.eu/consumers/odr/

16. Medical & Practice Disclaimers (Crucial Information)

  • 16.1 Ayurveda & Marma Therapy: Consultations and therapies are complementary and alternative therapies designed to support holistic wellbeing. They are not a substitute for professional medical advice, diagnosis, or treatment from a qualified medical doctor or specialist. Always consult your doctor before altering any prescribed medication or starting new herbal supplements.
  • 16.2 Kalaripayattu Training: Kalaripayattu is a rigorous physical martial art. By booking and participating, you acknowledge the inherent risks of physical injury. Participants must disclose any pre-existing injuries or medical conditions prior to training and participate at their own risk.
  • 16.3 Product Allergens: Natural cosmetics, oils, and Ayurvedic herbal supplements must be reviewed by the purchaser for potential allergens. We are not liable for misuse, allergic reactions, or adverse interactions with pharmaceutical medications.

17. Appointment, Retreat & Event Booking Policy

  • 17.1 Standard Appointments: Ayurvedic consultations, Marma therapy sessions, and private Kalaripayattu training require 48 hours’ notice for cancellations or rescheduling. Cancellations made with less than 48 hours' notice, or failure to attend, will result in the forfeiture of any non-refundable deposit paid, or a cancellation fee of 150 PLN / 30€ may be billed. Rescheduling prior to the 48-hour window is available without forfeiture of your deposit.
  • 17.2 Retreats & Organised Events: Due to the extensive planning required, the following cancellation policy applies to events:
    • More than 90 days before the event: Full refund (minus any non-refundable deposit).
    • 90 to 60 days before the event: 50% refund of the total event cost.
    • 60 days or less before the event: No refund will be issued. Retreats held outside the EU (e.g., India) may be subject to separate terms provided at the time of booking.

18. Confidentiality Client consultation records (including dosha assessments and clinical notes) remain strictly confidential and will not be shared without explicit consent, as required by GDPR (RODO) Article 9 regarding special categories of health data, except as legally mandated.

19. Force Majeure Delays or failures due to uncontrollable circumstances (e.g., strikes, extreme weather) are not breaches of these Terms.
