Política de cookies

For the website www.marmaayurveda.org/eu

Last updated: 14 September 2026

I. Data Controller and Scope of the Policy

  1. The data controller for the website www.marmaayurveda.org/eu and – to the extent that information obtained through cookies or similar technologies constitutes personal data – the data controller for such data is Marma Ayurveda Piotr Czopek, NIP 9442127860, REGON 545056990, address: ul. Leżakowa 9, 93-430 Łódź, email: info@marmaayurveda.org (hereinafter: “Controller”).
  2. This Policy describes the rules for storing information on the User’s end device and for accessing information already stored there using cookies and similar technologies on the Polish Website.
  3. This Policy applies exclusively to the Polish Website. The UK Website is operated separately and has its own cookie policy. The Controller does not use a shared cookie database or a shared user tracking mechanism between the Polish and UK websites.

II. Legal basis and fundamental principles governing the use of cookies

  1. The rules governing the storage of information on the User’s end device and the access to such information derive, in particular, from Articles 399 and 400 of the Act of 12 July 2024 – Electronic Communications Law (hereinafter: ‘ECL’).
  2. As a general rule, the use of cookies or similar technologies requires that the User be provided in advance with clear, straightforward and comprehensible information regarding the purpose of their use, and that their consent be obtained. Consent is not required in the cases specified in Article 399(3) of the ECA, in particular where the storage of or access to information is necessary for the transmission of a communication or for the provision of an electronically supplied service requested by the User.
  3. The provisions on the protection of personal data apply mutatis mutandis to the obtaining of consent for cookies. This means that consent should be voluntary, specific, informed and unambiguous, and that it should be possible to withdraw consent just as easily as it was given.
  4. Cookies and similar technologies that are not strictly necessary should not be activated until the User has made a choice. Merely continuing to browse the Website, failing to respond to a banner, or having settings ticked by default are not regarded as consent.
  5. If the information collected via cookies constitutes personal data, its further processing is also subject to the GDPR. In the case of optional technologies, the legal basis for the processing of personal data is, as a rule, consent – Article 6(1)(a) of the GDPR. With regard to strictly necessary technologies, the legal basis for the processing of personal data depends on the purpose of such processing and may, in particular, be derived from Article 6(1)(b) of the GDPR or Article 6(1)(f) of the GDPR, e.g. where processing is necessary to ensure the security of the Website.

III. Definitions and types of technologies

  1. Cookies are small pieces of information stored on the User’s device whilst using the Website and read during subsequent requests. They may be used, amongst other things, to maintain a session, remember the shopping basket or settings, ensure security, compile statistics or measure the effectiveness of marketing activities.
  2. The term ‘cookies’ as used in this Policy also covers – to the extent applicable – similar mechanisms for storing or retrieving information from an end-user’s device, such as local storage, device identifiers, tags or pixels, provided that their operation falls within the scope of Article 399 of the Electronic Communications Act.
  1. Cookies may be:
  1. session cookies – generally deleted at the end of the browser session;
  2. persistent – stored for a period specified for the technology in question or until they are deleted;
  3. first-party – set by the Website or within its domain;
  4. third-party – set or read by a third-party provider in connection with a feature or service embedded in the Website.
  5. Cookies are not used to download documents or any other files from the User’s device. However, they may contain or lead to the creation of online identifiers which – depending on the configuration and capabilities of the relevant provider – may enable the recognition of the browser or device and the analysis of the User’s activity.

IV. Categories of cookies and similar technologies

  1. Essential cookies – these are used to ensure the proper functioning of the Website and features explicitly requested by the User, e.g. maintaining a session, the functioning of the shopping basket, logging into an Account, security, handling the ordering process, and remembering cookie preferences. If the conditions set out in Article 399(3) of the Electronic Communications Act (PKE) are met, they do not require the User’s consent.
  2. Functional and preference cookies – these are used to remember settings or additional features, e.g. interface preferences. If a particular feature is not strictly necessary for the service requested by the User, the technology is only activated once consent has been given in the relevant category.
  3. Analytical cookies – these may be used to measure how the Website is used, the number of visits, traffic sources or behaviour on the site. Analytical technologies requiring access to the end device are only activated once consent has been obtained, unless a statutory exception applies in a specific case.
  4. Marketing and advertising cookies – these may be used to measure the effectiveness of adverts, conversions, remarketing or the creation of audience groups. They are activated only after the User has given the relevant consent.
  5. Third-party content and features – embedded videos, maps, social media plugins or other external elements may involve the use of a third-party provider’s technology. Unless the technology in question is covered by a statutory exception, the element should only be activated once the required consent has been obtained.

V. Technologies used on the Website

  1. The Website operates on the basis of WordPress and WooCommerce. Consequently, cookies may be used that are necessary for managing sessions, the shopping basket, orders, the Customer Account, security and other functions explicitly activated by the User. The specific names and expiry periods depend on the Website’s current configuration.
  2. The Website uses a cookie consent management mechanism (CMP) or an equivalent solution. Essential information recording the User’s choice may be stored without additional consent to the extent necessary to remember and respect their decision.
  3. The Controller may run Google Ads campaigns. The mere fact of running an advertising campaign outside the Website does not automatically mean that Google cookies are stored on the Website. If Google Ads tags are active on the Website, used for purposes such as conversion tracking, remarketing or personalised advertising, they are classified as marketing technologies and are only activated after the User’s consent has been obtained.
  4. As of the date of the last update to this Policy, the Controller does not state that it uses Google Analytics 4 or any other cookie-based analytics tools to track Users in a personally identifiable manner on the public pages of the Website. Should such a tool be implemented, it will be configured accordingly in the consent panel and described prior to its activation.
  5. The Controller uses tools related to the newsletter, including WordPress and Mailchimp. Subscribing to the newsletter is a separate process and is not conditional upon consent to marketing cookies. If a form embedded on the Website uses additional necessary or optional storage/access technologies, these are categorised according to their actual function and indicated in the consent panel.
  6. The presence of links leading to Facebook, Instagram, TikTok or other external websites does not in itself mean that the Website sets cookies from those entities. However, if plugins, videos or other external elements are embedded on the Website, their technologies are assessed in accordance with the principles set out in this Policy.

VI. Detailed list of active cookies

  1. A detailed and up-to-date list of technologies actually active on the Website is available in the ‘Cookie Settings’ panel or an equivalent consent management panel. The list should specify at least the name of the technology or file, the provider, the category, the purpose and the retention period or the criteria for determining it.
  2. The list in the consent panel supplements this Policy and should reflect the actual configuration of the Website. Technologies that have been disabled, removed or are only planned should not be presented as active.
  3. Following any significant change to the Website, in particular following the implementation of new plugins, advertising or analytics tools, integrations, embedded content, or a change to the way WooCommerce operates, the Administrator should verify the list of technologies and, where necessary, update the consent panel and this Policy.

VII. Managing consent and cookie settings

  1. On their first visit, Users are given the option to accept all optional categories, reject optional cookies or make a more detailed selection. Optional cookies are not selected by default and are not activated until consent is given.
  2. The User may change their selection or withdraw their consent at any time using the ‘Cookie Settings’ function available on the Website, in particular in the footer or via the permanent element of the consent management panel. Withdrawal of consent does not affect the lawfulness of actions taken prior to such withdrawal.
  3. You may also delete or block cookies via your browser settings. However, blocking essential cookies may cause certain functions to malfunction, such as the shopping basket, login, saving preferences or the order placement process.
  4. Consent to cookies does not constitute consent to receive the newsletter or other commercial information. Marketing consents relating to electronic communications are collected separately.

Manage your Consent

VIII. Personal data, recipients and transfers

  1. Depending on the technology used in connection with cookies, the data processed may include, amongst other things, internet identifiers, information about the device and browser, consent settings, data on interactions with the Website, and, in the case of certain providers, also the IP address or information about events on the Website. The Controller does not maintain a separate log of user traffic between the Polish and UK websites solely for the purpose of recording clicks on external links.
  2. Recipients of the data may include hosting providers, Website maintenance providers and IT tool providers, and, where appropriate consent has been given, also providers of analytics or marketing tools, if these are actually active. In particular, if Google Ads tags are activated, recipients of data related to this tool may include entities within the Google group, in accordance with their current policies and service configuration.
  3. Some providers may process data outside the European Economic Area. Where personal data is transferred to a third country, the Controller or the relevant provider shall apply the mechanism provided for in the GDPR, e.g. a decision establishing an adequate level of protection, including – where applicable – the EU-US Data Privacy Framework, or standard contractual clauses together with additional measures, if required.
  4. A detailed and up-to-date list of the technologies actually in use on the Website is available in the ‘Cookie Settings’ panel or an equivalent consent management panel. The list includes the name of the technology or file, the provider, the category, the purpose and the retention period or the criteria for determining it.

IX. The UK Website and links to external websites

  1. The PL Website and the UK Website are separate websites, operated by separate entities, with separate databases and cookie mechanisms. This Policy does not govern the use of cookies on the UK Website.
  2. If a User navigates from the Website to the UK website or another external site via a standard hyperlink, the privacy and cookie policies applicable to that site will apply from the moment the destination page is opened. The Controller does not use a shared cookie identifier to track the User between these separate websites.

X. Changes to the Policy and contact details

  1. This Policy may be amended, in particular in the event of changes to legislation, regulatory guidelines, the way the Website operates, or the implementation or removal of technologies affecting the use of the User’s end device. The current version is published on the Website together with the date of the last update.
  2. For matters relating to this Policy or the processing of personal data, you may contact the Controller by email at: info@marmaayurveda.org or in writing at: ul. Leżakowa 9, 93-430 Łódź.
