In case of conflicts, the provisions of those additional contracts shall prevail.

2. Binding By registering, accessing, or otherwise using this website, booking a consultation, or purchasing from our shop, you agree to these Terms and Conditions. The use of this website implies knowledge and acceptance of these terms.

7. Responsible Use Use the website only for lawful purposes. Activities causing damage, harassment, or interference to the site’s functionality are strictly prohibited.
8. Registration and Customer Accounts When creating a shop account, maintain the confidentiality of your passwords and information. Notify us immediately of any unauthorised account usage.
9. Refund, Return, and Cancellation Policy (Products and Digital Goods) This section applies to physical and digital products purchased through the Marma Ayurveda website. For our cancellation policies regarding Ayurvedic consultations, Marma therapy, Kalaripayattu training, and retreats, please refer to Section 17 of these Terms and Conditions.
- 9.1 Statutory Right to Cancel (Physical Goods): Under the UK Consumer Contracts Regulations 2013, if you purchase physical goods online, you have a legal right to change your mind and cancel your order within 14 days of receiving the goods.
- Notification: You must notify us of your decision to cancel within 14 days of the delivery date.
- Return Window: Once you have notified us, you have a further 14 days to return the physical items to us.
- Condition: To be eligible for a return, your item must be unused, in the same condition that you received it, and in its original, unopened packaging.
- 9.2 Non-Returnable Items (Hygiene & Digital Exceptions): Several types of goods are exempt from being returned under UK law for health protection, hygiene, or digital consumption reasons:
- Hygiene & Personal Care: We cannot accept returns on cosmetics, massage oils, herbal supplements, or wellness accessories (such as copper cups, tongue scrapers, and neti pots) if the protective seal has been broken, the packaging opened, or if there is any evidence of use.
- Digital Content: For eBooks, digital downloads, and online courses, your 14-day right to cancel is waived the moment you commence downloading or streaming the content, provided you agreed to this waiver at checkout.
- Gift Vouchers: Gift cards and treatment vouchers are non-refundable.
- 9.3 Faulty or Damaged Goods: Under the UK Consumer Rights Act 2015, goods must be as described, fit for purpose, and of satisfactory quality. If your product arrives damaged or is found to be faulty, you have a right to a full refund if you notify us within 30 days of receiving the item. Please contact us immediately with photographic evidence of the damage/fault so we can arrange a replacement or refund, and cover the return shipping costs.
- 9.4 The Refund Process: Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund based on the condition of the item. If approved, your refund will be processed, and a credit will automatically be applied to your original method of payment within 14 days of us receiving the returned goods.
- Original Outbound Shipping: If you are returning an entire order under the 14-day cooling-off period, we will refund the basic delivery cost you paid to receive the item (we do not refund enhanced delivery costs, such as next-day delivery).
- 9.5 Late or Missing Refunds: If you haven’t received an approved refund yet:
- Check your bank account again.
- Contact your credit card company or payment provider (e.g., Stripe/PayPal), as it may take some time before your refund is officially posted.
- Contact your bank, as there is often some processing time (typically 3-5 working days).
- If you’ve done all of this and you still have not received your refund, please contact us.

- Customer Responsibility: Unless the item is faulty or damaged upon arrival, you are responsible for paying your own shipping costs to return the item.
- Shipping Protection: If you are returning more expensive items (such as full copperware sets), we strongly recommend using a trackable shipping service or purchasing shipping insurance. We cannot guarantee receipt of your returned item and are not liable for items lost in the postal system.
10. Idea Submission Do not submit intellectual property unless we have signed a prior agreement. Without such agreement, submissions become the non-exclusive, royalty-free property of Marma Ayurveda.
11. Termination of Use We may modify or discontinue website access, courses, or services at our discretion without liability or compensation, provided any pending paid orders are fulfilled or refunded.
12. Warranties and Liability We disclaim all warranties regarding website content availability, accuracy, and specific health outcomes. Our liability is limited to the price paid for purchased goods or services.

16. Medical & Practice Disclaimers (Crucial Information)
- 16.1 Ayurveda & Marma Therapy: Karolina Raczynska provides holistic Ayurvedic consultations and Marma therapy. These modalities are complementary and alternative therapies designed to support holistic wellbeing. They are not a substitute for professional medical advice, diagnosis, or treatment from a qualified UK General Practitioner (GP) or medical doctor. Always consult your GP before altering any prescribed medication or starting new herbal supplements.
- 16.2 Kalaripayattu Training: Kalaripayattu is a rigorous physical martial art. By booking and participating in classes, workshops, or camps, you acknowledge the inherent risks of physical injury. Participants must disclose any pre-existing injuries or medical conditions prior to training and participate at their own risk.
- 16.3 Product Allergens: Natural cosmetics, oils, and Ayurvedic herbal supplements must be reviewed by the purchaser for potential allergens. We are not liable for misuse, allergic reactions, or adverse interactions with pharmaceutical medications.
17. Appointment, Retreat & Event Booking Policy
- 17.1 Standard Appointments: Ayurvedic consultations, Marma therapy sessions, and private Kalaripayattu training require 48 hours’ notice for cancellations or rescheduling. Cancellations made with less than 48 hours' notice, or failure to attend an appointment, will result in the forfeiture of any non-refundable deposit paid, or a cancellation fee of £30 may be billed. Rescheduling prior to the 48-hour window is available without forfeiture of your deposit. Discretionary exceptions may apply in cases of genuine emergency.
- 17.2 Retreats & Organised Events: Due to the extensive planning and upfront costs required for retreats, workshops, and training camps, the following cancellation policy applies to these events:
- More than 90 days before the event: Full refund (minus any non-refundable deposit).90 to 60 days before the event: 50% refund of the total event cost.60 days or less before the event: No refund will be issued.
18. Confidentiality Client consultation records (including dosha assessments and clinical notes) remain strictly confidential and will not be shared without explicit consent, except as legally required.
19. Force Majeure Delays or failures due to uncontrollable circumstances (e.g., postal strikes affecting shop deliveries, extreme weather cancelling an in-person event) are not breaches of these Terms.
